Introduction

These Supplementary Terms ("Insurance Terms") govern your access or use of the insurance self-network platform ("ISNP")operated by MFL and the insurance distribution services facilitated through the Platform by MFL in its capacity as a corporate agent. These Insurance Terms are in addition to and shall be read in conjunction with the General Terms and Privacy Policy of the Platform. In case of any conflict between these Insurance Terms and the General Terms, these Insurance Terms shall prevail to the extent of such conflict in relation to Insurance-related services.

1.1. ROLE OF THE PLATFORM

The Platform serves as a digital insurance distribution platform that connects you with various third-party Partner Insurers who offer different types of insurance products such as Dhan Suraksha, personal accident insurance products, health insurance products, and other insurance facilities(collectively referred to as "Insurance Products"

These Insurance Products include, but are not limited to motor, health, life, cyber, travel, home and content insurance, and/or any variants of that. Specific details of the various insurance products offered on the Platform can be accessed on the relevant insurance page(s) on the Platform, updated from time to time.

1.2. ABOUT MFL

MFL is a public limited company bearing CIN U65929KL1997PLC011518 and is a non-banking finance company (NBFC) registered with the Reserve Bank of India (“RBI”).

MFL is also an Insurance Corporate Agent (Composite) registered with the Insurance Regulatory and Development Authority of India (“IRDAI”) bearing registration number CA1017 valid till 15th Jan 2028.

1.3. ROLE OF MFL

MFL as a Corporate Agent for insurance distribution may promote, market, advertise and sell the Insurance Products of its partnered insurance companies registered with the IRDAI (“Partner Insurers”) in a manner permitted under the IRDAI (Registration Of Corporate Agents) Regulations, 2015.

You understand that insurance is subject to solicitation and market risks, and merely enquiring or submitting a proposal does not guarantee you insurance coverage from our Partner Insurers.You acknowledge that it is your responsibility to understand the limitations of insurance policies and the risks involved in such policies, and MFL has no liability in this regard.

You can avail insurance from any of these Partner Insurers through MFL as per your requirement and discretion. Please note that insurance is underwritten by the respective Partner Insurers and MFL does not underwrite the risk or act as an insurer. The contract of insurance is between the Partner Insurer and the insured only, and not between MFL and the insured. MFL is only acting as a distributor of the insurance products offered to by the third-party Partner Insurers. MFL does not charge any fees or commission from you for soliciting insurance products or for providing any services with regard to the insurance products of the Partner Insurers.

1.4. GROUP INSURANCE COVERAGE

MFL may also facilitate group insurance policies on the Platform, including group insurance policies linked to various products / services offered / facilitated on the Platform. As a User of the Platform, you may become eligible for cover under a group insurance policy obtained by MFL, at MFL’s sole discretion, and subject to the underwriting guidelines and requirements determined by the issuing insurance company.

Under the group insurance policy, MFL will assume the capacity of the master policyholder, and you will be the insured member / beneficiary. Please note that any benefit under the insurance cover shall be available provided (i) the relevant premium is received by the relevant insurance company that is offering the group insurance coverage on stipulated premium due dates, (ii) the policy is in force, and (iii) shall always be subject to the terms and conditions of the group insurance policy as prescribed by the insurance company.

MFL shall provide further details of the group insurance coverage, including the relevant insurance company providing such coverage, at the appropriate page on the Platform that facilitates purchase of the group insurance coverage.

PLEASE NOTE THAT GROUP INSURANCE POLICIES THAT MAY BE OBTAINED AND OFFERED TO YOU ARE DISTINCT AND INDEPENDENT OF THE INDIVIDUAL INSURANCE POLICIES DISTRIBUTED BY MFL ON THE PLATFORM IN THE CAPACITY OF A CORPORATE AGENT. ANY WITHDRWAL OF GROUP INSURANCE SCHEMES (FOR WHO OPTS OR OPTED THE GROUP INSURANCE SCHEME) WILL BE NOTIFIED BY THE RESPECTIVE INSURER DIRECTLY TO THE USER IN ADVANCE. THE ACTION AROUND THE MIGRATION OF SUCH SCHEMES WILL BE NOTIFIED TO THE USER BY THE RESPECTIVE INSURER.

Insurance Products Offered by Partner Insurers

The Platform facilitates the distribution of Insurance Products provided by MFL’s Partner Insurers. The Platform operates solely as a digital facilitator for MFL to enable access for purchase of Insurance Products provided by our Partner Insurers. (Note: Partner Insurers are one of the empanelled insurers with MFL).

The list of Partner Insurers whose insurance products are distributed by MFL on the Platform are set out below:

Terms of Insurance Products

You understand and acknowledge that the purchase of any Insurance Product through the Platform is purely voluntary and not linked to availing any other Platform Service or any other services of the MFL on the Platform.

You further understand and acknowledge that:

(a) the terms and conditions, including coverage, exclusions, premium amounts, claim processes, and other relevant details of the Insurance Products, shall be governed by the respective insurance policies issued by our Partner Insurers. Users are advised to thoroughly read and understand the insurance policy documents provided by our Partner Insurers before availing any Insurance Product.

(b) your insurance policy may lapse in case of non-renewal or non-payment of subsequent premiums by you. MFL is not liable for your policy’s status including any change in such policy effected due to your failure to renew the policy. However, MFL or Partner Insurer or both may reach out to you for reminders on renewal of your insurance policy.

(c) Insurance contracts are based on the principle of utmost good faith. When you apply for insurance, you must be completely honest and share all important details that could affect your coverage. This helps the insurance company decide whether to offer you insurance and on what terms. You must do this every time you start, renew, change, or reinstate your policy. If you leave out something important, it could hurt your chances of getting coverage or receiving the benefit. Also, MFL would not be responsible for any problems or losses caused by you not sharing that information. The insurance product information given in the Platform is indicative in nature. Nothing contained herein is to be construed advice, recommendation, offer for a policy or any other assistance. For more details on risk factors, product details, terms and conditions and exclusions, please read the relevant product brochure carefully before conclusion of sale.

In the event of any inconsistency between the terms and conditions of an insurance policy and these Terms (including these Insurance Terms), the terms and conditions of the insurance policy shall prevail to the extent of such inconsistency.

Application and Approval

MFL does not guarantee the approval of any insurance application and shall not be liable for any rejection or delay in the approval process. You further understand and acknowledge that:

(a) the provision of the insurance cover and the acceptance of your deposit as a premium are subject to the insurance company’s underwriting policies as guided in section 64VB of Insurance Act 1938

(b) the information provided by you will form the basis of the insurance policy

(c) MFL does not participate in the underwriting of any insurance risk

(d) MFL has no control or liability in relation to the insurance company’s decision regarding your proposal or any change in the premium, including without limitation any instance where an insurance company rejects your proposal and

(e) that the policy will come into force only after the realisation of the full payment of the premium to the respective Partner Insurer.

Additional Terms For Health Insurance Products

5.1. ACCURACY OF INFORMATION

You declare, on behalf of yourself and all individuals proposed to be insured, that the statements, answers, and particulars provided in the application for any Insurance Product on the Platform are true and complete to the best of your knowledge. You affirm that you are authorized to propose on behalf of these individuals intended to be insured.

5.2. NOTIFICATION OF CHANGES

You undertake to promptly notify us in writing of any changes in the occupation or general health of the life to be insured / proposer that occur after the proposal has been submitted but before the risk acceptance is communicated by the Partner Insurer(s).

5.3. CONSENT FOR MEDICAL INFORMATION

You consent for the Partner Insurer to seek medical information from any doctor or hospital that has attended to the person to be insured / proposer at any time, or from any past or present employer regarding anything affecting the physical or mental health of the person to be insured / proposer. Also, You provide your consent to the Partner Insurer for seeking information from any insurance company to whom your application for insurance for the person to be insured / proposer has been made, for the purpose of underwriting the proposal and / or claim settlement.

5.4. INFORMATION SHARING AUTHORIZATION

You authorize MFL and Partner Insurers to share information related to your proposal, including medical records of the insured / proposer, for the sole purpose of underwriting the proposal and / or claims settlement, and with any governmental and / or regulatory authority.

5.5. AUTHORIZATION FOR REPRESENTATIVES

You consent to and authorize any of the Partner Insurer’s authorized representatives, who may not be direct employees of the company, to seek medical information required for policy issuance or claim settlement from any hospital / medical practitioner that you or any person proposed to be insured/insured has attended or may attend in the future concerning any disease, illness, or injury.

Payment of Premium,Cancellation and Refunds

6.1. PAYMENT OF INSURANCE PREMIUM

You must ensure that any payment of insurance premium is made through a legally permitted mode of payment and subject to the arrangements made by the Partner Insurers for the collection of the same. If you are making a payment towards an insurance premium through a bank account, please ensure that the payment is remitted only through a bank account in your name. If the payment is made through a bank account opened in the name of a third party, MFL or the Partner Insurer may undertake enhanced due diligence measures at its sole discretion.

You understand that any payment made by you against an insurance policy is processed through the payment gateway partner of the Partner Insurer. MFL merely facilitates your access to such payment gateway partner’s services to enable you to make payments towards your insurance premium. All disputes regarding payments shall be the sole responsibility of the Partner Insurer as per the Applicable Laws.

6.2. FREE LOOK PERIOD.

As per Applicable Law, every policyholder of life and new health insurance policies, except for those policies with a tenure of less than one year, has a free-look period of 30 days (or such other free-look period as may be prescribed by IRDAI from time to time) starting from the date of receipt of the policy document to review the terms and conditions of such policy (“Free Look Period”).

We encourage you to read the insurance policy document carefully. If you disagree with any of the policy terms or conditions or otherwise do not make any claim, you have the option to return the policy to the Partner Insurer for cancellation within the Free Look Period, stating the reasons for the same. Once you place a cancellation request within the Free Look Period, the policy gets cancelled and you will be entitled to a refund of the premium paid, subject to deductions by the Partner Insurers as permitted under Applicable Law. You may contact Partner Insurer for the cancellation under the Free Look Period and its refund.

You acknowledge that all refunds shall be the sole responsibility of the Partner Insurers and MFL has no liability in this regard.

Prohibition of Rebates

NO PERSON (INCLUDING MFL) SHALL ALLOW OR OFFER TO ALLOW, EITHER DIRECTLY OR INDIRECTLY, AS AN INDUCEMENT TO ANY PERSON TO TAKE OUT OR RENEW OR CONTINUE AN INSURANCE IN RESPECT OF ANY KIND OF RISK RELATING TO LIVES OR PROPERTY IN INDIA, ANY REBATE OF THE WHOLE OR PART OF THE COMMISSION PAYABLE OR ANY REBATE OF THE PREMIUM SHOWN ON THE POLICY, NOR SHALL ANY PERSON TAKING OUT OR RENEWING OR CONTINUING A POLICY ACCEPT ANY REBATE, EXCEPT SUCH REBATE AS MAY BE ALLOWED IN ACCORDANCE WITH THE PUBLISHED PROSPECTUSES OR TABLES OF THE INSURER.

Claim Process

The claim process for the Insurance Products shall be governed by the terms and conditions of the respective insurance policies issued by the Partner Insurers. Users are required to follow the claim procedures specified by the insurers for the settlement of claims. MFL shall not be responsible for the processing or settlement of any insurance claims.

In respect of insurance claims requests raised by Users to MFL, MFL shall be obligated to provide only the contact details and / or the details of claim process of the relevant Partner Insurers for the Insurance Products availed by the Users, and the Platform may facilitate redirection of Users to the relevant Partner Insurers’ website for initiating claims. However, MFL shall not be responsible or liable for actual processing of the Users’ insurance claims.

Confidentiality and Data Privacy

We may seek and collect certain basic personal details from you while displaying the Insurance Product on the Platform. Such details may include your Personal Data such as your name, age, email ID, and PAN number. Your explicit consent shall be sought for collection of such Personal Data, and processing of such information shall be subject to our Privacy Policy.

We may share certain information about you to our Partner Insurers upon your request for an Insurance Product on the Platform, subject to our Privacy Policy. Your personal and financial information will be handled in accordance with the Privacy Policy of the Platform, relevant privacy policies of the concerned Partner Insurer and applicable data protection laws.

General Disclaimers and Disclosures

10.1. REMUNERATION FOR INSURANCE PLANS

You acknowledge that MFL is entitled to receive remuneration for the Insurance Products offered on the Platform in accordance with Applicable Law, which can be disclosed to you upon request.

10.2. IRDAI DISCLAIMER

The IRDAI does not engage in activities such as selling insurance policies, announcing bonuses, or investment premiums. If you receive such phone calls, you should lodge a police complaint.

10.3. MFL DISCLAIMER

MFL or its officials will not ask OTP for unauthorized solicitation of insurance or seek commission or any proceeds out of sale of insurance or proceeds of insurance claims.

10.4. INFORMATION AND LIABILITY

You understand that the Insurance Products available on the Platform, along with any related information, are provided by the respective Partner Insurers. MFL in its capacity of a registered Corporate Agent, merely makes these Insurance Products and information thereof accessible to you through the Platform functioning as an ISNP (Insurance Self Networking Platform). MFL assumes no liability or responsibility for the information provided and displayed on the Platform by the Partner Insurers. All such information, products, and services are provided on an “as is” and “as available” basis without any warranty.

10.5. DETERMINATION OF BENEFITS

You understand that MFL has no role in determining the returns, maturity benefits, guaranteed additions, death benefits, surrender value of any insurance policy, or the decision to honour or reject a claim. MFL shall not be liable for any changes in returns or benefits illustrated or explained during policy solicitation.

10.6. TAX BENEFITS

Tax benefits (if any) are subject to tax laws, including any changes thereto. MFL does not provide tax or investment advisory services. Please consult your tax advisor before purchasing any insurance policy.

10.7. PRICING AND DISCOUNTS

You understand that pricing of every Insurance Product is decided by the Partner Insurers and any discounts on Insurance Products offered on the Platform are provided by the Partner Insurer and not by MFL.

Disclaimers of Liability

PURCHASE OF INSURANCE PRODUCTS ARE SUBJECT TO TERMS AND CONDITIONS AS MAY BE COMMUNICATED BY THE PARTNER INSURERS INVOLVED IN SELLING / FACILITATING THE RELEVANT INSURANCE PRODUCT AVAILED BY YOU. YOU ARE ADVISED TO READ THE SAID TERMS AND CONDITIONS CAREFULLY PRIOR TO PURCHASE OF INSURANCE PRODUCTS ON / THROUGH THE PLATFORM.

SUBJECT TO APPLICABLE LAWS, MFL SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR ADVERSE CONSEQUENCES ARISING FROM YOUR USE OF OR RELIANCE ON ANY INSURANCE PRODUCT FACILITATED THROUGH THE PLATFORM. THE COMPANY DISCLAIMS ALL RESPONSIBILITY FOR THE PERFORMANCE, AVAILABILITY, SECURITY, OR CONTENT OF THE INSURANCE PRODUCTS. ANY DECISION TO PURCHASE AN INSURANCE PRODUCT IS MADE AT YOUR SOLE RISK AND RESPONSIBILITY AND ANY DISPUTES, CLAIMS, OR ISSUES ARISING FROM INSURANCE PRODUCTS MUST BE RESOLVED DIRECTLY WITH THE RESPECTIVE PARTNER INSURERS.

YOU HEREBY ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL MFL BE RESPONSIBLE OR LIABLE FOR ANY ACTS OR OMISSIONS OF THE PARTNER INSURERS INCLUDING BUT NOT LIMITED TO COMPLIANCE WITH APPLICABLE LAWS, RULES, REGULATIONS, CIRCULARS AND GUIDELINES ISSUED BY IRDAI.

No Endorsement

MFL in its capacity does not endorse or guarantee the Insurance Products or services offered by Partner Insurers. The availability of Insurance Products on the Platform does not constitute an advice or recommendation by MFL. Users are advised to exercise their own prudence and judgment while availing any Insurance Product.

Servicing Related Terms

13.1. REMUNERATION FOR INSURANCE PLANS

(a) Proposal form: You are required to fill out a proposal form in order to apply for any Insurance Product on the Platform. Please note that the information required under each proposal form may vary across Insurance Products. Typically, you are required to submit details such as gender, age, income, profession, education level, coverage required, etc.

(b) KYC norms: MFL may require you to submit such information and documents about you as may be required under Applicable Laws, relevant KYC policies of the Partner Insurers and MFL’s KYC policies. You are required to provide complete, accurate, updated and consistent information for any such requests for information or documents.

(c) Payment of premiums: In order to submit the proposal form, you are required to make payment of the insurance premium through the payment gateway partner of the Partner Insurer or the corporate agent involved, as the case may be. The modes of payment available depend upon the arrangement between the insurance company and the payment gateway service provider, and typically include UPI, debit card, credit card, etc.

Please note that the relevant payment gateway facilitating payment of insurance premium may charge you additional service / convenience fee at its own discretion, and MFL is not responsible for any such additional charges / fees levied by the payment gateway. Users are advised to independently verify the recipient of the premium to be paid by them, and exercise caution on any payment frauds committed by third-parties.

(d) Acceptance of the proposal: Upon payment of the insurance premium, the details provided by you are shared with the Partner Insurer. The Partner Insurer at its sole discretion may accept or reject the proposal by you.

13.2. REMUNERATION FOR INSURANCE PLANS

(a) Download policy document: You may download the policy document/ certificate of insurance by logging into your account on Muthoot FinCorp ONE.

(b) Cashless claims: You may view on the Partner Insurer platform, the list of partnered hospitals where you may avail cashless claims for health insurance availed through MFL Platform.

(c) Servicing of claims: You may contact our service executive at customercare@muthoot.com for any claim related queries.

Servicing TAT

MFL as a corporate agent, shall endeavour to follow its service level turnaround times (“TAT”) as documented in the insurance policy documents in relation to the Insurance Products availed by you, subject to receipt of necessary information and documents from insurers.

The TATs are defined for raising the customer requirements / grievances and coordinating with the respective Partner Insurer for resolving the service issues that are dependent on them for resolution. MFL will not be in breach of the TATs if the matter is pending resolution from the Partner Insurer.

Grievance Redressal in Relation to Insurance Products

To exercise any of the rights or share any grievance or queries regarding the Insurance Products purchased through the Platform, you may write to us at customercare@muthoot.com or contact us at 1800 102 1616. If you do not receive a satisfactory response within 14 (fourteen) days or if you are not satisfied with the resolution provided, you may reach out to our Grievance Redressal Officer as mentioned below:

In the event you do not receive a response within a reasonable period of time or are dissatisfied with the response provided, you may approach the Insurance Ombudsman for redressal (find your nearest Insurance Ombudsman here or approach the IRDAI’s Bima Bharosa Portal here.
