Introduction

These Supplementary Terms govern your use and access of the payments module on the Platform that facilitates various bill payments, repayments and recharges (“ Payments Terms ”). These Payments Terms are in addition to and shall be read in conjunction with the General Terms and Privacy Policy of the Platform. In case of any conflict between these Payments Terms and the General Terms, these Payments Terms shall prevail to the extent of such conflict in relation to Payment Facilities facilitated on the Platform.

1.1. ROLE OF MFL.

MFL is an agent institution onboarded by One Mobikwik Systems Limited, an authorized Bharat Connect Operating Unit (“ BCOU ”) registered with National Payments Corporation of India (“ NPCI ”) and RBI. MFL is not responsible for undertaking the underlying billing or recharge. The responsibility of providing these services lies with the respective billers and service providers. MFL’s role is limited to facilitating the payment process and ensuring that the payment is transmitted to the respective biller or service provider

The Payment Services should not be construed as MFL providing or reselling any of the services provided by your biller / service provider.

1.2. ROLE OF THE PLATFORM.

The Platform serves as a digital interface that facilitate various bill payment, recharges and repayment services (“ Payment Services ”) from the Payments module on the Platform. The Payment Services include, but may not be limited to:

  1. (i) Utility bill payments (electricity, water, piped gas, etc.)
  2. (ii) Municipal tax payments
  3. (iii) FASTag recharge
  4. (iv) Mobile and DTH recharges
  5. (v) Broadband and landline bill payments
  6. (vi) Insurance premium payments
  7. (vii) Loan and credit card repayments
  8. (viii) Payments related to chit funds*

* The chit funds payments facilitated as part of the Payment Services related to chit funds is managed by Muthoot Pappachan Chits Private Limited as the foreman (“Muthoot Chits”). MFL is not directly involved in operating or managing the chit funds in any capacity, other than facilitating payments towards the chit funds. User Responsibilities

You hereby agree to:

  1. Provide accurate and complete information for the payment or recharge transaction, including payment details such as details of the biller / bill number, amount of the bill etc. MFL shall not be responsible for verifying the accuracy of the information / details provided by you.
  2. Verify the details of the transaction before confirming the payment.
  3. Ensure sufficient funds in your account or valid payment instruments for the transaction.
  4. Promptly update any information that becomes inaccurate or incomplete.
  5. Use only your own payment instruments and not use the Platform to facilitate transactions for third parties without appropriate authorization.
  6. You represent and agree that the Payment Services availed by you shall not be used to make fraudulent transactions or for unlawful and / or illegal purposes.
  7. You agree that you are responsible for all transactions undertaken by you by availing the Payment Services and in the event of any wrong payment made to an incorrect party, MFL shall not be liable to reimburse you or reverse such payment.

Transaction Processing

To avail the Payment Services on the Platform, you will be required to submit relevant details which may include but is not limited to your mobile number, your bill number, bill amount and other bill related details. You hereby authorise MFL to further fetch your bill / repayment due and other information from the relevant billers or service providers to enable your timely payment of bills. You hereby explicitly and unconditional consent to allow MFL to collect, access, use, store, process and disclose information related to your bill payments and other related information for the purpose of facilitating the Payment Services.

MFL does not guarantee the uninterrupted availability of the Payment Services and shall not be liable for any delays or failures in processing payments due to technical issues or other reasons beyond MFL’s control.

Upon successful payment, you will receive a confirmation message on the Platform.

In case of a failed transaction, the amount will be refunded to your account or payment instrument as per the refund policies of the respective biller or service provider.

You understand that the actual time for the payment to be credited to the biller’s account may vary depending on the biller and the payment method used.

Fees and Charges

Any applicable service fee or charges for the Payment Services will be communicated to you at the time of the transaction. You hereby agree to pay the service fee or charges as specified for the respective Payment Services. MFL reserves the right to revise the service fees or charges at any time. You hereby agree and acknowledge that continued use of the Payment Services after such revision will constitute your acceptance of the revised fees or charges.

Cancellation and Refunds

Recharges of your Mobile / DTH and other utility payments are real time transactions and once the transaction is successful there will be no refund or exchange permitted. Please be alert that you are responsible for accuracy of the details entered by you to make a payment and / or recharges and all charges that result from those recharges / services.

You further agree that MFL will not be liable for any failure on the part of any biller / service provider in effecting a recharge or other bill payment or for any issue related to the quality of service provided by the biller.

Refunds, if applicable, will be processed as per the policies of the respective biller or service provider. You acknowledge that all refunds shall be the sole responsibility of the billers or service providers, and MFL has no liability in this regard.

Kindly note that any convenience fee or processing fee or such other charges paid to MFL for facilitating the payment for a successful recharge & bill payment shall be non-refundable as the same shall be incurred by us towards payment gateway charges.

Dispute Resolution

You agree and acknowledge that all disputes or issues related to the successfully processed and appropriately notified payments, recharges or repayments made by you must be resolved directly with the respective biller or service provider.

MFL shall not be responsible for any disputes arising from the services provided by the billers or service providers.

Disclaimer

MFL DISCLAIMS ALL RESPONSIBILITY FOR THE PERFORMANCE, AVAILABILITY, SECURITY, OR CONTENT OF THE PAYMENT SERVICES. MFL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE PAYMENT SERVICES.

MFL OR THE RELEVANT BILLER / SERVICE PROVIDER MAY PROVIDE YOU WITH DETAILS OF PLANS / SCHEMES OFFERED BY THE CONCERNED BILLER / SERVICE PROVIDER FOR RECHARGE. HOWEVER, IT SHALL BE YOUR SOLE RESPONSIBILITY TO VERIFY AND ASCERTAIN THE ACCURATE PLAN / SCHEME AMOUNT PRIOR TO MAKING PAYMENT FOR THE RECHARGE. MFL SHALL IN NO WAY BE LIABLE OR RESPONSIBLE FOR A WRONG RECHARGE AMOUNT, EVEN IF THE PLAN DETAILS WERE SUGGESTED BY MFL.

IN THE EVENT OF ANY WRONG PAYMENT MADE, YOUR SOLE REMEDY WILL BE TO APPROACH THE BILLER OR PARTY TO WHOM THE PAYMENT WAS MADE.

THE USER HEREBY ACKNOWLEDGES AND AGREES THAT MFL IS NOT THE ULTIMATE SERVICE PROVIDER. CONSEQUENTLY, THE PROVISION OF THE SERVICE, ITS USAGE, AND ALL RELATED ASPECTS HEREIN INCLUDING BUT NOT LIMITED TO BILLING AMOUNTS, PRE-POPULATED CHARGES, USAGE DETAILS, AND ANY EXTRA CHARGES OR PENALTIES IMPOSED BY THE SERVICE PROVIDER, ARE ENTIRELY OUTSIDE THE PURVIEW, CONTROL, AND VISIBILITY OF MFL. IN THE EVENT OF ANY DISPUTE, CLAIM, OR DISCREPANCY RELATED TO THE FOREGOING, THE USER SHALL BE SOLELY RESPONSIBLE FOR CONTACTING THE SERVICE PROVIDER DIRECTLY FOR RESOLUTION. MFL EXPRESSLY DISCLAIMS ANY AND ALL INVOLVEMENT IN SUCH MATTERS, SHALL NOT BE PARTY TO ANY SUCH DISPUTE, AND DENIES ALL LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, FOR ANY CLAIMS, LOSSES, COSTS, OR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM THE ACTS, OMISSIONS, OR DATA OF THE SERVICE PROVIDER.

Privacy and Data Security

As part of the Payment Services, you may be required to submit various data or information for us to process and facilitate the payment, which may include your Personal Data such as relevant account number, phone number, etc. All data collected by MFL through the Platform shall be used, processed, and protected in accordance with our Privacy Policy.

Communications

By using the Payment Services, you hereby explicitly consent to receive communications related to your transactions from MFL and the respective billers or service providers. You agree that any notices or other communications required or permitted under these Payments Terms may be provided electronically.
